By accessing or using Verifitly ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Description of Service

Verifitly is an idea validation platform that helps entrepreneurs test business ideas. The Service includes:

• AI-powered landing page generation
• Waitlist signup tracking and analytics
• Viability scoring and AI insights
• Distribution content generation for social platforms
• Market research and competitive analysis

3. Account Registration

3.1 Account Requirements

• You must be at least 18 years old to use the Service
• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized use of your account

3.2 Account Responsibilities

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from unauthorized access to your account.

4. Subscription and Payment

4.1 Subscription Plans

The Service offers the following subscription tiers:

• Starter: $12/month - 3 ideas, 15 AI generations/month
• Pro: $29/month - 15 ideas, 60 AI generations/month
• Scale: $79/month - 50 ideas, 150 AI generations/month

Annual plans are available at a discounted rate (2 months free).

4.2 Payment Processing

Payments are processed by Stripe. By subscribing, you agree to Stripe's Terms of Service.

4.3 Billing

• Subscriptions are billed in advance on a monthly or annual basis
• Your subscription will automatically renew unless cancelled
• Price changes will be communicated 30 days in advance

4.4 Refunds

We offer a 7-day money-back guarantee for new subscribers. After 7 days, subscription fees are non-refundable. You may cancel at any time, and your access will continue until the end of your current billing period.

4.5 Generation Limits

AI generation limits reset monthly. Unused generations do not roll over. Additional generation packs can be purchased and do not expire.

5. Acceptable Use

5.1 You Agree Not To:

• Use the Service for any illegal purpose
• Create landing pages promoting illegal products or services
• Generate content that is defamatory, obscene, or harmful
• Impersonate any person or entity
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to our systems
• Use automated systems to access the Service without permission
• Collect user information without consent
• Resell or redistribute the Service without authorization

5.2 Content Restrictions

Landing pages and ideas must not contain:

• Illegal content or promotion of illegal activities
• Hate speech or discrimination
• Sexually explicit material
• Violence or threats
• Malware or phishing attempts
• Pyramid schemes or fraudulent business models
• Copyright-infringing material

We reserve the right to remove any content and terminate accounts that violate these restrictions.

6. AI-Generated Content

6.1 Nature of AI Content

Content generated by our AI (landing pages, distribution posts, market analysis) is created automatically based on the information you provide. We do not guarantee the accuracy, completeness, or suitability of AI-generated content.

6.2 Your Responsibility

You are responsible for:

• Reviewing all AI-generated content before publishing
• Ensuring content is accurate and appropriate for your use case
• Verifying any claims or statistics in generated content
• Compliance with applicable laws and regulations

6.3 No Endorsement

AI-generated market analysis, viability scores, and insights are for informational purposes only. They do not constitute business, legal, or financial advice. We do not endorse or guarantee the success of any business idea.

7. Intellectual Property

7.1 Your Content

You retain ownership of the ideas and content you submit. By using the Service, you grant us a license to store, display, and process your content as necessary to provide the Service.

7.2 Generated Content

You own the AI-generated content created for your ideas (landing pages, posts, etc.) and may use it freely for your business purposes.

7.3 Service Content

The Verifitly platform, including its design, code, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our platform without permission.

8. Landing Page Hosting

8.1 Subdomain Hosting

Published landing pages are hosted at subdomains of verifitly.com (e.g., your-idea.verifitly.com). We reserve the right to:

• Reject or remove subdomain names that are offensive or misleading
• Unpublish pages that violate these Terms
• Modify the hosting infrastructure as needed

8.2 Availability

We strive for high availability but do not guarantee 100% uptime. Landing pages may be temporarily unavailable during maintenance or due to technical issues.

8.3 Subscription Lapse

If your subscription lapses, your landing pages will be unpublished and visitors will see a redirect. Your data will be retained for 30 days, allowing you to resubscribe and restore access.

9. Waitlist Data

Email addresses collected through your landing pages are stored securely and visible only to you. You are responsible for:

• Complying with email marketing laws (CAN-SPAM, GDPR) when contacting signups
• Having a legitimate purpose for collecting emails
• Honoring unsubscribe requests

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VERIFITLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

WE MAKE NO GUARANTEES REGARDING THE SUCCESS OF YOUR BUSINESS IDEAS, THE ACCURACY OF VIABILITY SCORES, OR THE EFFECTIVENESS OF AI-GENERATED CONTENT.

12. Indemnification

You agree to indemnify and hold harmless Verifitly from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

13.1 By You

You may cancel your subscription at any time through your account settings. Your access will continue until the end of the current billing period.

13.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse the Service or our support team
• Fail to pay subscription fees

13.3 Effect of Termination

Upon termination, your landing pages will be unpublished and your data will be deleted after 30 days. You may request a data export before deletion.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in San Francisco, California.

You agree to waive your right to a jury trial and to participate in a class action lawsuit against us.

16. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and Verifitly.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Waiver: Our failure to enforce any right does not constitute a waiver of that right.
• Assignment: You may not assign these Terms. We may assign them in connection with a merger or acquisition.
